In Belgium, nitrous oxide is not a controlled drug, but its sale has been regulated since late 2023: it is banned except for medical or technical use, or as a food additive. A professional kitchen using it in a siphon therefore falls precisely within the exception the law preserves. Two rules still apply to you: sale is banned to under-18s since February 2022, including online, and the hazardous nature of the gas must be stated on the cartridges.
What the Belgian framework says
The subject is sensitive because the product is widely misused. For a professional, it comes down to four points — and none of them stops you working.
| Rule | Since | What it changes for a professional kitchen |
|---|---|---|
| Sale banned to under-18s, including online | February 2022 | Nothing, if you order in the name of the business. But a minor apprentice cannot go and collect an order. |
| Sale, import, possession and transport banned except for medical, technical or food-additive use | late 2023 | Use in a siphon is the exception provided for. Keep your invoices: they establish the professional purpose. |
| Recreational use and possession banned — general police regulation, 19 communes | 2020 (Brussels) | Targets misuse, not kitchens. But stock left lying in the dining room is harder to justify than stock in the store room. |
| Hazard statement required on the cartridges | — | That is the manufacturer's job. Check it on delivery: an unmarked cartridge has no place in your store room. |
One point many people miss: these rules are Belgian. If you are established in Luxembourg, France, the Netherlands or Germany, your national framework may differ, even when buying from a Belgian wholesaler. France, for instance, has legislated separately. Check the law of your country of establishment, not that of the seller.
✅ You are in the permitted case
Use as a food additive is the exception the royal decree preserves. Working with a siphon in a professional kitchen remains entirely legal.
🧾 Keep your invoices
They establish the professional purpose of your purchases. Stock with no record of purchase is harder to explain than stock invoiced to the business.
🔞 Never to a minor
Sale has been banned to under-18s since February 2022, in store as online. That also covers sending an apprentice to collect an order.
What it actually does in a kitchen
Food-grade N2O does one thing: it pressurises the contents of a siphon so they expand on the way out. Whipped cream, espumas, savoury foams, aerated sauces. The gas dissolves into the fat under pressure, then expands sharply when released — that is what creates the aeration.
Whipped cream chargers (EM-250050)
Food grade, for a professional kitchen siphon. That is the one criterion that is not up for negotiation: a technical cartridge does not have the same purity.
- Box of 50 pieces — €22.80
- €0.456 per charger
- One charger fills a one-litre siphon
- Sold to registered trade customers only
Choosing your chargers and your siphon
Three criteria, and only one really counts.
- The food grade of the gas. This is the one non-negotiable criterion. A cartridge made for technical use does not have the same purity and has no place in a kitchen siphon.
- The capacity of the siphon. A one-litre siphon covers service in a standard restaurant; in pastry work or banqueting, the refill rate becomes the limiting factor.
- The pack size of the chargers. They do not expire in practice and take up little room: ordering by box of 50 avoids running out mid-service, at a lower cost per gram.
On maintenance, the siphon strips down completely and the head seal is the part that fails first. It is also the hygiene checkpoint most often forgotten — our HACCP cleaning plan sets out how to build it into a schedule without making it heavier.
ISI 1 L whipping siphon (DR-00100007)
The service size for a standard restaurant. Fully strippable, which determines how well it can be cleaned — the head seal is the part that fails first.
- 1 litre capacity
- €94.40 — investment written off over years
- Strips down for a full clean
- To be built into the HACCP cleaning plan
What it costs per service
Catalogue prices as of 14 October 2026. The useful calculation is not the price of the charger but its cost spread across the portions served.
| Item | Reference | Pack size | Cost |
|---|---|---|---|
| Chargers | EM-250050 — whipped cream | 50 pieces — €22.80 | €0.456 per charger |
| Siphon | DR-00100007 — ISI 1 L | each — €94.40 | investment, written off over years |
One charger fills a one-litre siphon. On house-made whipped cream served in dessert portions, that works out at a few cents of gas per plate — negligible against the cost of the cream itself. So the saving is never on the charger: it is on not running out on a Friday night.
The rest of the kit
The siphon is one of the few kitchen items where the consumable is trivial and the use is regulated. For the rest of your supply, three of our guides cover the essentials:
- The guide to professional food packaging in Belgium, for everything that leaves the kitchen.
- Our file on the HACCP standard in catering, which sets the hygiene framework the siphon's upkeep belongs to.
- And our criteria for choosing a HORECA supplier, if you are comparing wholesalers.

Frequently asked questions
Can a restaurant buy N2O chargers in Belgium ?
Yes. The royal decree of late 2023 bans the sale, import, possession and transport of nitrous oxide except for medical, technical or food-additive use. Use in a kitchen siphon falls under the last of these. Keep your invoices: they establish the professional purpose.
Can it be sold or handed to a minor ?
No. Sale has been banned to under-18s since February 2022, in store as online. In practice this also means a minor apprentice cannot be sent to collect an order.
Do the same rules apply in other countries ?
No, and that is the trap. The framework described here is Belgian. A French, Luxembourgish, Dutch or German business comes under its own national law, even when buying from a Belgian wholesaler. France in particular has legislated separately. Check the law of your country of establishment.
What is the difference between a food-grade and a technical cartridge ?
The purity of the gas and the control that goes with it. A cartridge made for technical use is not produced to come into contact with food. It is the one non-negotiable selection criterion: everything else — brand, pack size, price — comes after.
How many portions from one charger ?
One charger fills a one-litre siphon, which covers several dozen dessert portions depending on dosage. Per plate, the cost of the gas is counted in cents and weighs far less than the cream. The issue is not the price of the charger but availability mid-service.
